Conditions of participation for the competition organized by E-M-C-direct GmbH & Co. KG as part of a customer survey
Organizer and purpose of the competition
The competition is run by E-M-C-direct GmbH & Co KG, Salierweg 14, 46286 Dorsten, hereinafter referred to as the "organizer". The competition serves as a "thank you" to the participating customers who provide the organizer with their feedback. Participation in the competition is voluntary and free of charge and is governed exclusively by these conditions of participation.
Eligibility to participate
All natural persons who have reached the age of 18, are customers of the organizer and have completed the customer survey online via Microsoft Forms are eligible to participate. Employees of the organizer and their relatives are excluded from participation. Participation is not dependent on the purchase of goods or services.
Persons who are not customers of the organizer are not eligible to participate in the competition. The organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example
a) in the event of manipulation in connection with the running of the competition,
b) in the event of breaches of these conditions of participation,
c) in the event of false or misleading information in connection with participation in the competition.
Entry period
The competition begins on 21.02.2024 and ends on 21.03.2024. All entries received outside this period will not be considered in the draw.
Conditions of participation
Participation in the competition takes place by completing the customer survey online via Microsoft Forms [Link: https://forms.office.com/e/YmtDqNTE5N]. Participation is only possible once per person.
By submitting the questionnaire, the participant accepts these conditions of participation.
Prizes
A total of three prizes will be awarded:
1. Hot air fryer: Ninja Air Fryer 3,8L, Gray & Black, AF100EU | 149,99 Euro (RRP)
2. Bluetooth headphones: soundcore Liberty 4 NC (Black) | 89.99 euros (RRP)
3. Massage gun: Hand-held Muscle Massage Gun | 35,98 Euro (RRP)
The winners will be determined after the closing date in a random draw on 11.04.2023 from all eligible participants who have completed the customer survey in full.
The winners will be notified by email within one week. In the event of an undeliverable notification, the organizer is not obliged to make further inquiries and may determine new winners. If the winner does not respond within four weeks of notification of the prize, the organizer is also entitled to determine a new winner. An exchange or cash payment of the prizes is not possible.
Termination of the competition
The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to amend these conditions of participation.
Data protection
Participation in the competition requires the provision of personal data. Participants assure that the personal details they provide, in particular their first name, surname and e-mail address, are true and correct. In the case of non-cash prizes, further personal data, such as address, will be requested from the winners after the end of the competition as part of the prize notification. The collection and processing of personal data serves exclusively to carry out the competition and, if applicable, to send the prizes. All data will only be stored for the purpose and for the duration of the competition and will be deleted at the end of the campaign, provided there are no statutory retention obligations.
Participants agree to their personal data being collected, processed and used by Microsoft Forms. Participants have the right to withdraw their consent to the processing of their data at any time and to request its deletion. An e-mail to info@emc-direct.de is sufficient for this purpose. Once consent has been withdrawn, the participant's personal data that has been collected and stored will be deleted immediately.

Liability
The organizer is not liable for damages caused by errors, delays or interruptions in data transmission during participation in the competition. The organizer is also not liable for damages caused by technical problems or unforeseen events, such as force majeure, during participation in the competition.
Severability clause
Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
Applicable law and place of jurisdiction
The competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
